What Does the Law Say About Dog Bites?
Though most states have moved to have strict liability laws—where the dog owner is held responsible for the victim’s injuries—Georgia’s dog bite laws are not so favorable for victims. In order to succeed in a dog bite claim, a victim must be able to prove more than one ground of liability under the Georgia Dog Bite Statute.
- Georgia code requires that a victim prove:
- The dog was vicious or very dangerous;
- The owner was aware of this fact; and
- The owner failed to properly manage or restrain the animal.
